Please read these Terms and Conditions ("Terms") carefully before using the BG Eraser application ("the App") operated by Robles Code ("we", "our", or "us").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on your personal device for personal, non-commercial purposes, subject to these Terms. You may not copy, modify, distribute, sell, lease, sublicense, or reverse-engineer the App or any part of it.

2. Description of Service

BG Eraser is a photo editing application that allows users to remove backgrounds from images using on-device artificial intelligence. The App also provides manual editing tools, crop functionality, and image export options. All processing is performed locally on the user's device.

3. User Content

You retain full ownership of all images and content you create, edit, or process using the App. We do not claim any rights over your content. Since all processing is done on your device, your content is never uploaded to our servers or any third-party service.

You are solely responsible for the content you edit and share using the App. You agree not to use the App to process or distribute content that is illegal, infringing, defamatory, or violates the rights of others.

4. Intellectual Property

The App, including its design, code, AI model, graphics, icons, and overall appearance, is the intellectual property of Robles Code and is protected by applicable copyright and intellectual property laws. The U2NetP model used in the App is used under its respective open-source license.

5. Acceptable Use

You agree to use the App only for lawful purposes. You may not:

  • Use the App to create, edit, or distribute illegal, harmful, or offensive content.
  • Use the App to infringe on the intellectual property rights, privacy, or other rights of any third party.
  • Reverse-engineer, decompile, disassemble, or attempt to extract the source code of the App.
  • Modify, adapt, or create derivative works based on the App.
  • Use the App for any commercial purpose without prior written consent.
  • Attempt to bypass, disable, or interfere with any security features of the App.

6. Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

  • The App will meet your specific requirements or expectations.
  • The App will be uninterrupted, timely, secure, or error-free.
  • The results obtained from the use of the App, including AI-generated background removal, will be accurate, complete, or satisfactory for any particular purpose.
  • The App will be compatible with all devices or operating system versions.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Robles Code be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising out of or in connection with your use of the App, whether based on warranty, contract, tort, or any other legal theory, even if we have been advised of the possibility of such damages.

Our total liability for any claims arising from or related to the use of the App shall not exceed the amount you paid for the App, if any.

8. AI-Generated Results

The background removal feature uses artificial intelligence, which may not always produce perfect results. The accuracy of the AI model depends on factors including image quality, complexity of the subject, and lighting conditions. We do not guarantee the accuracy or quality of AI-generated results. Manual editing tools are provided to refine the output.

9. Device Requirements

The App requires a compatible device with sufficient processing power and storage to run the on-device AI model. Performance may vary depending on your device's hardware specifications. We are not responsible for any performance issues caused by insufficient device capabilities.

10. Updates

We may release updates to the App from time to time. These updates may include bug fixes, new features, or improvements. While we are not obligated to provide updates, we recommend keeping the App up to date for the best experience. Continued use of the App after updates constitutes acceptance of any modified Terms.

11. Termination

You may stop using the App and uninstall it at any time. We reserve the right to discontinue the App or restrict access to it at any time without prior notice. Upon termination, all rights granted to you under these Terms will immediately cease.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Mexico, without regard to its conflict of law provisions. Any disputes arising from these Terms or the use of the App shall be subject to the exclusive jurisdiction of the courts located in Mexico.

13. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Robles Code regarding the use of the App and supersede any prior agreements or understandings.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will update the "Last updated" date at the top of this page. Your continued use of the App after any changes constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.
